By creating an account or using Cothyra (the "Service"), you agree to these Terms of Service. Please read them. If you don't agree, don't use the Service.
1. Who provides the Service
Cothyra is operated by the named individual or entity behind it. Payments are processed by our merchant of record (Paddle.com), who is the seller of record on your invoice. Their terms and refund handling apply alongside ours.
2. Accounts and eligibility
You're responsible for keeping your sign-in credentials secure. Notify us promptly if you suspect unauthorized access. One account per person — sharing logins is not allowed and may result in suspension.
Eligibility and territory: you must be at least 13 years old to use the Service. The Service is not offered in, and may not be accessed or used from, mainland China. By using the Service you represent that you are not doing so from mainland China. We may use technical measures (such as geographic restrictions) to enforce this, and may suspend accounts that circumvent it.
3. What Cothyra does
The Service lets you read and edit text content, organize it as books, and ask an AI assistant for help with that content. AI calls run on third-party model providers (Anthropic, OpenAI, others) and are subject to their availability and policies.
4. Credits and payment
- The Service is sold on a pay-as-you-go credit basis. You buy a credit pack; AI calls deduct from it based on token usage at vendor cost plus a small markup.
- Prices are shown in USD on the pricing page and at checkout. Local taxes may be added by our merchant of record.
- Purchased credits don't expire as long as your account is active.
- Refunds: see our Refund Policy.
5. Free signup credits
- New accounts may include a one-time grant of free credits (currently 500), made at our discretion so you can use the Service without paying. The grant is per account and is not recurring.
- Free credits are consumed before any purchased credits.
- Free credits work with most AI models and features; a small set of premium models may require purchased credits.
- Free credits are promotional: they have no cash value, are non-transferable and non-refundable, and don't count toward any refund calculation.
- We may change the grant's amount, eligibility, or covered models — or discontinue it — at any time. One person accumulating free credits across multiple accounts is a violation of these Terms.
6. Acceptable use
You agree not to use the Service to:
- Generate content that violates the law where you live or where the Service is operated;
- Attempt to reverse-engineer, scrape, or stress-test the Service in ways that affect others' use;
- Resell access, share your account, or expose AI capabilities to a third party without written permission;
- Generate content that infringes intellectual property, contains personal data of others without consent, or constitutes harassment, hate, sexual content involving minors, or instructions for illegal activity.
Violations may result in suspension. On suspension, free promotional credits are forfeit; your purchased credit balance remains refundable under the Refund Policy, less any losses we can substantiate from the violation — except in cases of fraud, payment abuse, or chargeback abuse. We may report serious abuse to the relevant authorities.
7. Your content
You own what you write. You grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, cache, back up, transmit, process, and display your content solely to operate and provide the Service — including sending relevant text to the AI provider of the model you select, caching copies in your browser, keeping operational backups, and serving any public share links you create, to anyone who has the link, until you revoke them. This licence ends when you delete the content or your account, subject to the retention described in the Privacy Policy. We claim no ownership of your content and do not use it to train shared models.
Sensitive data: the Service sends the text you work on to third-party AI providers (see the Privacy Policy). It is not designed for regulated or high-risk data — do not store or submit medical or health records, biometric or genetic data, government identification numbers, payment card numbers, passwords, credentials or API keys, or sensitive personal data about other people. If you include such data anyway, you do so at your own risk and you are responsible for having a lawful basis to process and share it.
8. Copyright and content complaints
If you believe content made publicly available through the Service (for example via a share link) infringes your rights, email [email protected] with: (a) the URL of the content, (b) identification of the work you believe is infringed, (c) your name and contact details, and (d) a good-faith statement that the use is unauthorized. We review notices promptly, remove or disable access to content where appropriate, inform the user who posted it, and consider counter-statements. Accounts that repeatedly share infringing content lose the sharing feature or are terminated.
9. AI output disclaimer
AI assistants make mistakes. Output may be inaccurate, biased, or unsuitable for professional use without human review. Don't rely on AI output for medical, legal, financial, or safety-critical decisions. Verify before trusting.
10. Service availability
We aim for the Service to be available, but we don't guarantee uptime. Underlying AI providers occasionally fail or rate-limit; the Service reflects those outages. Failed AI calls are not charged when no tokens were consumed; partial token usage is charged based on what was actually consumed.
11. Disclaimers and limitation of liability
The Service is provided "as is" and "as available," without warranties of any kind, express or implied — including fitness for a particular purpose and non-infringement. You use the Service at your own risk and remain responsible for your own safety and attention while using it: in particular, when listening to audio playback (voice reading) while driving, cycling, walking, or doing anything else that requires your focus, keep your attention where the law and common sense require it. Always comply with applicable laws.
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the twelve months preceding the claim, and we are not liable for indirect, incidental, special, or consequential damages, or for loss of profits or data. Nothing in these Terms limits liability that cannot be limited by law.
12. Termination
You can stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms. On termination you can request a refund of unused credits per the Refund Policy.
13. General terms
- Severability: if any provision of these Terms is found unenforceable, the rest remain in effect, and the provision is enforced to the maximum extent permitted.
- Assignment: you may not assign these Terms without our written consent; we may assign them to a successor of the Service (and will announce a change of operator as a material change).
- No waiver: not enforcing a provision is not a waiver of the right to enforce it later.
- Force majeure: neither party is liable for delay or failure caused by events beyond reasonable control (outages of underlying providers are addressed in "Service availability").
- Notices: we send notices to the email on your account; you send notices to [email protected]. Email satisfies any writing requirement.
- Entire agreement: these Terms, the Privacy Policy, and the Refund Policy are the entire agreement between us regarding the Service.
- Nothing in these Terms limits mandatory consumer protections of the country where you habitually reside.
14. Changes
We may update these Terms. Material changes will be announced on the landing page or via email. Continued use after the change date counts as acceptance.
